PRENUPTIAL AGREEMENTS
A premarital agreement, also referred to as a prenuptial agreement, is an agreement between a couple made in contemplation of marriage. It must be in writing and signed by both parties. It becomes effective upon the marriage of the engaged couple.
Once the couple is married, changes can be made and it could even be revoked. Again, it must be in writing and signed by both husband and wife.
A prenuptial agreement is a personal document and should be written to meet the needs of the engaged couple. The agreement should be fair, reflect the goals of each party, and be understood fully by both people. It is strongly recommended that each party be represented by a family law attorney during each phase of the discussions.
